§ 1 Scope

These Terms and Conditions apply to the use of the learning platform “Jario” (jario.app) between you and Seweryn Krzysztof Korzekwa, Virginiastraße 14, 66482 Zweibrücken (hereinafter “I”). Deviating terms do not apply.

§ 2 Services

Jario offers programming tasks that you work on in the browser, automated tests and an AI tutor. There are two plans:

• Free (€0): the tasks of the first 2 chapters with tests, saved progress and 5 questions to the AI tutor per day.
• Pro (€5/month): all tasks from all chapters, saved progress and 30 questions to the AI tutor per day.

The AI tutor’s answers are generated automatically and may contain errors. I strive to ensure availability that is as uninterrupted as possible, but cannot guarantee it, for example during maintenance or outages. I may further develop tasks and features as long as the core of the service is preserved.

§ 3 Account

To use the platform you need an account with a valid email address. You must keep your login credentials secret. The Pro subscription may only be taken out by persons of legal age, or by minors with the consent of their parents or legal guardians.

§ 4 Conclusion of contract, prices and payment

You take out the Pro subscription via the “Subscription” page. By clicking the payment button in Stripe’s payment form, you submit a binding offer; the contract is concluded as soon as the payment is confirmed. The price is €5/month and is payable in advance for each month. Payment is processed by the payment service Stripe.

As a small business under Section 19 of the German VAT Act (UStG), I do not charge VAT and do not show it on invoices.

§ 5 Term and cancellation

The Pro subscription runs for one month at a time and is automatically renewed for a further month unless you cancel. You can cancel at any time with effect from the end of the current month: via the link Cancel contracts here at the bottom of every page, on the “Subscription” page via “Manage or cancel subscription”, or by email to hello@jario.app. Pro remains active until the end of the paid month. You can delete your free account at any time in the account settings.

The right to termination for good cause remains unaffected, for example in the event of serious misuse under § 6.

§ 6 Fair use

The code execution service is intended for learning. In particular, it is not permitted to attack the platform or other systems, to circumvent the sandbox, to use computing power for unrelated purposes (such as crypto mining) or to overload services through automated means. In the event of violations, I may suspend your account.

§ 7 Liability

I am liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence, I am liable only for breach of an essential contractual obligation, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely, and in that case limited to the foreseeable damage typical for this type of contract.

§ 8 Changes to these Terms

I will notify you of changes to these Terms and Conditions by email at least four weeks in advance. If you do not agree, you can cancel the Pro subscription before the changes take effect.

§ 9 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.

Withdrawal Policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform me (Seweryn Krzysztof Korzekwa, Virginiastraße 14, 66482 Zweibrücken, email: hello@jario.app) of your decision to withdraw from this contract by means of a clear statement (e.g. an email or a letter sent by post). The easiest way to do this is via the Withdraw from contract function at the bottom of every page. You may also use the model withdrawal form below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, I shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which I am informed about your decision to withdraw from this contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Even if you requested that the service begin during the withdrawal period, I will refund the full amount to you if you withdraw. You pay nothing for the time used up to that point.
